CISPA: Another Law To Spy On Internet Users



Why CISPA is coming under fire?

One section of CISPA says that "notwithstanding any other provision of law," companies may share information with Homeland Security, the IRS, or the National Security Agency. By including the word "notwithstanding," CISPA's drafters intended to make their legislation trump all existing federal and state laws, including ones dealing with wiretaps, educational records, medical privacy, and more.

Here we go again internet lover's! Once again our anti-American law makers are trying to pass yet another law that will allow our government to spy on any and all of our records using the internet. These sorts of laws is why it is imperative that we keep a constant vigil over what these people are up to. From their actions over the past couple of years, they appear to be looking for any reason whatsoever to be able to enact martial law and spy on us whenever they feel like it. Once agtain, it is time to take action and show these people that we will NOT stand by and turn America into a new communist country by going to the White House PETITION and signing to stop CISPA in it's tracks. Or, you may go to the AVAAZ.org site to sign their petition, which already has 767,728 signatures and counting.



George Zimmerman Arrested for 2nd Degree Murder



George Zimmerman is under arrest, charged with second degree murder in the shooting death of Trayvon Martin, a Florida special prosecutor announced Wednesday.

(1) What is second degree murder?
Florida's jury instructions (which are based on the Florida statute) spell out three elements that prosecutors must prove to establish second degree murder beyond a reasonable doubt:

• The victim is deceased,
• The victim's death was caused by the defendant's criminal act, and
• There was an unlawful killing of the victim "by an act imminently dangerous to another and demonstrating a depraved mind without regard for human life."

The last element -- an "imminently dangerous" act that shows a "depraved mind" -- is further defined by Florida's jury instructions. Three elements must be present:

• A "person of ordinary judgment" would know the act, or series of acts, "is reasonably certain to kill or do serious bodily injury to another";
• The act is "done from ill will, hatred, spite, or an evil intent"; and
• The act is "of such a nature that the act itself indicates an indifference to human life."

HR 347 Signed on March, 8th 2012

So, a funny thing happened while on this conference call to urgently figure out what we could to prevent Obama from signing it. After all, he was a constitutional law professor before he became a politician.During the conference call, a woman broke in, and said: “I have some very bad news. Obama signed this bill – HR 347 – today. He signed it today.” Today – March 8th – International Women’s Day. The bill was law. 

My e-mail to the President, and all of my Representatives:

Dear Mr. President, I, as a life-long democrat, didn't think that our president could do anything worse to destroy the U.S. Constitution and american civil liberties than it did with the passage of the NDAA, until now. I cannot fathom why you have signed HR 347 into law when the right to protest is sewn within the very fabric of America's greatness. You are allowing our country to be destroyed in the name of terrorism; with these laws, I say that the terrorist have won by default. I am ashamed that I gave birth to children who will witness the lawful destruction of America the free, and the birth of America the Communist. Shame on you, Sir.

HR347 The Bill That Ends The Right To Assemble

This bill works to further outlaw the American citizen's right to assemble, and protest the way that our government is conducting business in OUR names. Please go HERE to sign a petition to have President Obama veto this bill. The anti-American laws that are being passed are forever changing the foundation upon which our nation was built upon, and it is OUR DUTY as American citizens to do everything within our power to stop it.

It is these very laws that make the terrorist the winners by default. They are stripping away our rights by using fear tactics as their sword. By taking away our rights to protest, they are leaving the American people only one choice left to keep our government a government that still belongs to the people, and in the end, when all else has failed, the final option left to us will be civil war. That may sound extreme, but ask the people in Iraq, and many other nations who have had their countries hijacked, and had no laws to protect them so that they may peaceably assemble and fight for their rights in a non-violent manner. Some people laugh and even verbally insult protesters, but it is those people who are ignorant of the value of the right to protest, and the ability it has to prevent a nation from otherwise having to wage war against it's government to achieve representation within their government. War Against Women

While 8 in 10 Democrats said they supported requiring birth control coverage, only 4 in 10 Republicans did. Six in 10 people calling themselves independents voiced approval. Many Americans, in the survey and in independent interviews, expressed impatience with the focus on women’s reproductive issues in an era of economic distress. Mr. Obama, Democratic leaders and many women’s health advocates say the issue is a matter of basic health care and describe the opposition as part of a broader Republican war on women. 

Make no mistake people, the Republican party is waging a war on women, and all of their medical rights. Trying to ban abortion hasn't been good enough, now they are trying to make it difficult, if not impossible for some of the nation's poorer women, to be able obtain birth control. I wonder if they take into account how high the number of abortions would rise if they are successful in making birth control more difficult for women to get, not to mention the rise in sexually transmitted diseases. Republicans just do not think. Case in point, the cost that America would incur just in caring for those additional people who would be infected with HIV would be astronomical; then add the number of unwanted children, abandoned to foster care, or added to the welfare system by mothers who weren't prepared to become a parent, those alone could pay for birth control for decades, perhaps even a century.

These people are why the fight to keep church and state separate must never waiver. They say that they want smaller government, except for when it comes to personal rights, and if they had their way, they would make premarital sex a felony, for women, and homosexuals would be imprisoned for life. It is every Americans DUTY to keep a close eye on our government, state and federal, and do what we must to keep this nation the free and sovereign nation it was meant to be, a nation not only for freedom OF religion, but of freedom FROM religion.

“Although the Constitution permits communities to enact most laws they believe to be desirable, it requires that there be at least a legitimate reason for the passage of a law that treats different classes of people differently. There was no such reason that Proposition 8 could have been enacted."

  "Proposition 8 serves no purpose, and has no effect, other than to lessen the status and human dignity of gays and lesbians in California, and to officially reclassify their relationships and families as inferior to those of opposite-sex couples," states the opinion written by Judge Stephen Reinhardt, one of the court's most liberal judges." Finally, humanity takes another small step in the right direction. I am still amazed how willing people are to walk all over the basic human rights of smaller groups of individuals, merely because of who they are, how they feel,   or whom they love. Somehow it offends some people's sensibilities about their perception of right and wrong, and somehow, they feel they have a right to impose their will upon others, despite the pain that they cause in the process. I don't know if humanity, as a whole, will ever be able to look past themselves enough to embrace empathy, and look at life from other people's perspective. In essence, we all are the same... we all laugh, cry, love, bleed red, live, and die, we're all human beings who just want to be happy, the best way that we can. Perhaps someday, we will all be capable of seeing that the differences between us all is what keeps life intriguing, and that is truly beautiful.

These findings point to a vicious cycle, according to lead researcher Gordon Hodson, a psychologist at Brock University in Ontario. Low-intelligence adults tend to gravitate toward socially conservative ideologies, the study found. Those ideologies, in turn, stress hierarchy and resistance to change, attitudes that can contribute to prejudice, Hodson wrote in an email to LiveScience.

Some of us have been saying it for years folks, stupidity breeds biggotry. Sadly, until science finds a way to raise the collective IQ of all of humanity, it seems that we will unlikely be able to educate this problem away. We live in societies filled with hatred, low self-esteem, mental illness, hopelessness, and a whole other range of emotions just bursting at the seems to find an outlet. Unfortunately the easiest targets are usually the minority races, or other unusuals in society such as homosexuals or people who dress out of the norm, and so forth, who get picked out by these people to be tortured and ostracized, denied basic human rights and liberties, and be balked at by people. Some of us wonder if humanity will have a chance to evolve above such petty ignorace before 'mother nature' wipes us out of existance, much the way she did the dinosaurs, or if those of us with higher IQ's will be forced to suffer the fools for a few more millennia before things change. Who knows.

NDAA 2012 UPDATE



 

Since I came back into the world of politics, and discovered that Congress had passed yet another law that massacres the U.S. Constitution and the U.S. Bill of Rights, I have been e-mailing President Obama, all of my local representatives, and everyone else that I can think of, trying to put the pressure on to get this bill amended. I hope that millions of others are doing the same. This bill is bar none, the most dangerous bill that has ever been allowed to become a law in this nation, ever! I found this page today on Wiki that is rather informative, for those of you who need more details.

I have been embedded in long time arguements with both democrats and republicans on the details of where this nation is headed, the poor job that our elected officials are doing to truely represent the people that 'hired' them to shape the future of our country, and many other subjects, but none come close to the magnitude that this subject carries, because this subject affects every single American equally...for it is our very freedom, for life, that is at stake.

Faced With SOPA Protest, One Senator Just Blinked

(1)The latest grumblings (or lack thereof) from the lawmakers on Capitol Hill suggest that they're coming around to the idea that they might've latest anti-piracy efforts in the House and the Senate might've been a little hasty. Patrick Leahy, a senator from Vermont who co-authored the PROTECT IP anti-piracy bill, posted a press release on Thursday, confessing that his legislation needed "more study" before implementation. It's a sure sign that's he's starting to cave to political pressure -- much of which is coming from the unexpectedly increasingly politically powerful Reddit -- and other lawmakers could follow suit.

Then again, they could not. Take Lamar Smith, the Texas congressman who authored the Stop Online Piracy Act (SOPA) which is the House's more incendiary and more draconian version of the Senate's PROTECT IP. News broke on Thursday that Smith himself engaged in some questionable copyright practices in building his personal website. The Texas congressman had used a photo that he didn't necessarily have the right permissions for, and in an unapologetic report, Vice's Jamie Lee Curtis Taete put him on the spot with a report unapologetically titled "The Author of SOPA Is a Copyright Violator." The photo thing was a small thing by any measure and probably not something that would get the man thrown in jail. But nobody likes a hypocrite.

Smith isn't sorry about what he did. In a Reuters interview published a few hours after Vice's somewhat sensational scoop, Smith vowed not to back down and even questioned how or why his colleagues would listen to what can only be described as a deafening protest against Congress's anti-piracy legislation. "It is amazing to me that the opponents apparently don't want to protect American consumers and businesses," Smith said. "Are they somehow benefitting by directing customers to these foreign websites? Do they profit from selling advertising to these foreign websites? And if they do, they need to be stopped. And I don't mind taking that on."

Well, Lamar Smith, the Internet does mind your taking that on. We're not just talking about Reddit, either. Pretty much every major American tech company has stepped forward to protest the current version of SOPA, warning how it stands to quell innovation (read: kill jobs) despite Smith's past arguments that SOPA is a job-saving bill. Indeed it would help the entertainment industry to lock in more profits, but it would also change the architecture of the open web, opening the door to government censorship and possibly shutting down popular sites like Facebook, Twitter and YouTube, some say. Along those lines, legal scholars have called the bill unconstitutional, an assault on Americans' First Amendment rights. The Senate's PROTECT IP is, in many ways, a watered down version of SOPA, but it's also a bill that aim to solve a problem that Congress has more or less admitted it doesn't understand. So it's not a surprise at all that Senator Leahy would blink when confronted with the challenge of pushing the legislation forward. It remains surprising that Smith won't back down.

Earlier this week, Politico floated a hypothesis: "SOPA becoming election liability for backers." (That's inside-the-Beltway headline speak for "Americans appear to hate SOPA, politicians appear to start listening.") At the time, it seemed almost speculative to say that folks like Leahy or Smith would listen to the web's collective outrage about the laws and change their stances on the legislation. After all, it is an election year. So far SOPA's made a villain out of at least one politician, quite randomly. Paul Ryan is not the SOPA proponent that Smith is, but in an attempt to flex their crowd-powered muscle, Reddit decided to go after Ryan and helped raise thousands of dollars for his opponent's campaign. After Reddit's initial threat, Ryan's office denied that he supported the bill. But the damage was done.

What happens next depends on a number of factors. For PROTECT IP, a judgment day is peeking over the horizon in the form of a procedural vote scheduled for January 24. For SOPA, a hearing is scheduled for next Wednesday, during which a number of Internet experts (read: huge nerds) will testify, we predict, in strong opposition to the bill before the House Committee on Oversight and Government Reform, of which outspoken SOPA opponent Rep. Darrell Issa is the chairman. Reddit co-founder Alexis Ohanian is one of the scheduled witnesses, and in solidarity with his vocal protest against the legislation, the link-sharing site will go dark for 12 hours. Other websites, like all of the meme-tastic Cheezburger blog network will follow suit.

It's unclear what's next for Smith and the House Judiciary Committee, where most of the hearings on SOPA have taken place. So far, he's not blinking like his colleagues and contradicting the many statements made by job-creating tech industry leaders. "There are some companies like Google that make money by directing consumers to these illegal websites," Smith told Reuters on Thursday. "So I don't think they have any real credibility to complain even though they are the primary opponent." Ohanian, one of those entrepreneurs that Smith is portraying as a villain, has said that SOPA would "cripple the Internet" and isn't shy about stating the bill's real implications bluntly. "This (SOPA) could potentially obliterate the entire tech industry -- a job-creating industry," Ohanian wrote on his blog recently. But if you're the type that likes to listen to Harvard professors, it could also obliterate the entire Internet as we know it.

Today we all got the dreaded news that yet another one of our dear Rattler's authors and renowned Paltalk Chatter Vicki Jo, passed away Sunday, Jan. 8, 2012, she was 52. Isa's was much loved and will be greatly missed. Our heartfelt condolences to all of Vicki Jo's loved ones and know she will forever be in our hearts.


As I heard the news I started to search though-out The Rattler to read some of Isa's posting  and I was reminded how witty, funny, and smart Isa was. One post its was almost like she was leaving a message to us all and it simply said:

"The world we live in is full of uncertainty and sorrow... maybe "heaven" is when we no longer inhabit this earth."

Isa, thank you for all the hours you shared with us, for all the laughs and heads up and even the occasionally debate that you always fought with grace.  Always a lady, never will you be forgotten.

I want to send out my sincerest thanks to jellybean, for giving me that extra push I needed to fulfill my long overdue promise to Mark and keep The Rattler running. Jellybean thank you from the bottom of my heart, I truly owe you one (or two or three lol).

I had promised Jesus Claus that I would continue  The Rattler the very last time I had talk to him (I didn't know at the time I would never hear his voice again) and it's beyond time for me to keep that promise. Mark was one of the funniest, kindest and smartest men paltalk has or ever will know and so now in his memory The Rattler is open for business, let the games begin.

I love you Mark and never will that love dim, remember keep the door open I can't wait to see you again in a better place and time.

This section does not exempt U.S citizens from the presidential power of military detention: only from the requirement of military detention.”(1)

This is what happens when Americans fall asleep and follow their government with blinders on. The laws that were passed during the Bush administration began what is becoming the eradication of the Constitution and The Bill of Rights. It is the responsibility of the people to ALWAYS keep their government in-check, making sure that they are following both the laws of the land, and the will of the people.. in not doing so, we the people, are losing the most valuable rights that this country has. The very laws that this country was based upon are being trashed in the name of fear, that's how it begins people.

More and more people are completely losing faith that ANY real number of politicians will be elected to office that will truely be there to enforce the will of the people, and bring this country to the greatness that she was always meant to be. With the passage of this law, it is my hope that people will be awakened to their civic responsibilities, and the absolute importance to NEVER follow their government blindly. I believe that MORE protest need to be staged so that people may make their views known, and be more assured that our government knows that THEY WORK FOR US, and that we.. the people of the United States, will not be forced into a communist nation as other countries in the past have been.
